Paving The Way to FTO in Patent Litigation

Overview

In a patent infringement case involving skid steer attachments used for road widening and shouldering, the LE team developed a cost effective litigation strategy including stipulating to damages if liability is found, and focusing on defending and defeating the liability claim.  After securing a Court Order compelling plaintiff to produce certain technical documents, our clients, an Australian manufacturer of road widening equipment and its U.S. distributor, were able to reach an amicable settlement with the patent owner.
