Overview
Leason Ellis represented Town & Country, a New York based innovator in developing consumer products, resolve a dispute with Home Shopping Network, its affiliate Ingenious Designs, and Joy Mangano, over rights to a clothes dryer and luggage. The claims asserted included design patent and copyright infringement, misappropriation of trade secrets (federal and NY Law), misappropriation of ideas, quantum meruit, unjust enrichment, breach of contract and tortious interference. The LE team obtained a rare reversal when the Court granted our motion for reconsideration and reinstated a misappropriation of ideas claim that had been improperly dismissed. We subsequently secured dismissal of a number of the defendants’ counterclaims and defenses with prejudice and obtained sanctions against defendants to pay our client’s attorneys’ fees and costs relating to (i) any discovery on a belatedly asserted counterclaim for breach of contract, which counterclaim was then dismissed with prejudice, and (ii) a supplemental expert deposition. The case was ultimately settled after argument on motions for summary judgment and to exclude experts, shortly before trial.References
