Honeywell International Inc. v. Celeris Controls, Claim Number: FA1010001351938 (NAF 2010)
Honeywell, through its subsidiary Phoenix Controls Corporation, had long used and registered the mark CELERIS for the design and manufacture of precision airflow control systems. In 2008, without authority or permission, former employees of Honeywell established a distribution business in the Middle East named Celeris Controls and registered the domain names celeriscontrols.com and celerisme.com. To reclaim the infringing domain names, in 2010, Honeywell filed a Complaint with the National Arbitration Forum under the Uniform Domain-Name Dispute-Resolution Policy (UDRP). While most respondents typically fail to respond to domain name Complaints, respondent submitted a detailed response arguing that it registered the domain names in good faith due to its prior business relationship with Honeywell. To rebut the contentions of Respondent, we prepared and filed a supplementary submission. In a lengthy decision, the Panel disagreed with Respondent and found that it had registered and used the domain names in bad faith in violation of the UDRP. As a result, it ordered their transfer to Honeywell.
