In April of 2011, the U.S. Department of Commerce issued its “Report to Congress on Litigation Tactics and Federal Government Services to Protect Trademarks and Prevent Counterfeiting.” The report was mandated by Congress, which stated that the Secretary of Commerce shall study and report on the extent to which small businesses may be harmed by litigation tactics, the purpose of which is to enforce trademark rights beyond a reasonable interpretation of the scope of the trademark owner’s rights. This article, titled “Trademark bullying: legitimate problem or passing fad?,” published in the April/May edition of World Trademark Review magazine, posits that despite a lackluster response to the report, trademark bullying is a real problem that disproportionately affects small businesses, and is something that the whole trademark community needs to address.
