Traditional illustrators are up in arms over the use of artificial intelligence to generate images. So writes graphic designer Ellen Shapiro in an article for PRINT Magazine titled “How Worried Should Creative Professionals Be About Artificial Intelligence?” Among other things, she notes that the competitive aspect of design presages whether AI-generated art will be eligible to win competitions. The answer may be informed in part by who rights to the final product under copyright law. The article gives the last word on the issue to Leason Ellis partner Marty Schwimmer, who posits that AI models are one more tool that helps users generate content. According to Marty, “the copyright analysis will be comparable to the analysis we use today when artists use the various illustration tools, graphics editors, paint programs, and other digital art tools: Is the work sufficiently original when divorced from the accompanying tools?”
