Judge Koeltl agreed that the plaintiff's claims for trademark infringement, unfair competition, breach of contract, and associated business torts had no merit insofar as plaintiff had not accumulated sufficient rights in the asserted trademarks to preclude the use of similar marks for lottery tickets by several state lotteries.
