Defending Trade Dress Infringement Action, Leason Ellis Leverages Victory on Motion to Dismiss Based on Lack of Personal Jurisdiction Into Settlement

Defending a claim of trade dress infringement in a case brought in the United States District Court for the District of Washington against Mamiya America Corporation arising out of the sale of double socket mount arm products, Leason Ellis moved to dismiss the Complaint on the grounds that our client was not subject to personal jurisdiction. The Court granted our motion to dismiss, and then we filed a motion seeking attorneys’ fees. After the lawsuit was re-filed in New York, we were able to leverage the fee motion to achieve a settlement of the dispute.
