Maintaining exclusivity in registration at the U.S. Trademark Office and having a robust enforcement program helped the fashion company Chanel to prevent registration of the mark CHANEL for real estate services under a dilution theory. The case discussed in this article, titled “CHANEL for real estate services held to dilute Chanel’s famous mark,” first published on June 9, 2014 in World Trademark Review Daily, demonstrates the value of good trademark enforcement practice. By keeping the Register free of other CHANEL marks and being able to demonstrate its vigorous enforcement program, Chanel was able to prevail in an opposition to the mark CHANEL for unrelated activities.
