Amicus briefs are important because they function to provide the court with information and arguments, based on law, public policy and common sense, that the parties, who are understandably advocating their self-interests to win, do not. The goal is to help the court reach a principled, correct rule of law, that can then be fairly applied to the facts of the case, as well as to the different facts of future cases, and thereby avoid a train wreck result for the IP world. In this piece, Rob Isackson reflects on his work over the past year in authoring three U.S. Supreme Court and two U.S. Circuit Court appellate amicus briefs for two different organizations focused on protecting strong IP rights and the benefits they confer.
