Yuval Marcus participated in successfully defeating a motion to quash a subpoena in a patent infringement action served upon counsel who acted as both prosecution and litigation counsel for the patentee. The Court agreed with the arguments that counterclaim defendant Voguestrap was entitled to take the deposition of the patentee's attorney in support of its defense of inequitable conduct based on the patentee's failure to disclose to the Patent Office all of the true inventors of the product at issue in the case.
