Peter Sloane has written a commentary titled “Trademark Scams: It’s Time for PTO Action” for the Westlaw Journal on Intellectual Property Law. The analysis points out a loophole in trademark filings that allows non-attorneys to evade detection and represent trademark owners before the Office. It suggests that the Office make the technical changes necessary to permit searching of the email address of the attorney of record, which would allow the Office and others to more easily find those scammers engaging in the unauthorized practice of law.
