The Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office recently upheld the refusal to register BRASSERIE KUNZ as primarily merely a surname for restaurant services. See In re Kunz Management LLC (2017). That the addition of the generic word BRASSERIE was not sufficient to alter the perception of the mark as merely a surname was in line with TTAB precedent. The case is also an instructive reminder on how to submit internet evidence, as the Board refused to consider evidence that applicant provided only via links rather than as prints of the webpages themselves.
