Magistrate Judge Robert C. Mitchell of the United States District Court for the Western District of Pennsylvania issued a Report and Recommendation in The Foreign Candy Company, Inc. v. R.L. Albert & Son, Inc., Civil Action No. 10-999, recommending that defendant's motion to transfer the action to the U.S. District Court for the District of Connecticut be granted. In recommending transfer, the Court found that the District of Connecticut has a greater interest in adjudicating the case since R.L. Albert resides there and the only connections with the Western District of Connecticut were one sale of defendant's product and plaintiff's counsel's offices. Paul Fields, Yuval Marcus and Cameron Reuber filed the motion on behalf of R.L. Albert.
