Investigations have long been an important part of trademark practice in the United States. Since China has rapidly become one of the most important trademark jurisdictions in the world, this is a good time to compare investigation techniques in the U.S. and China. There are several important differences, which U.S. practitioners should know before instructing trademark investigations in China, especially in connection with non-use investigations. This article, first published in the July/August 2013 edition of Landslide magazine, a publication of the ABA Section of Intellectual Property Law, explores those differences including in methods of investigation, cost and quality.
