Novartis AG v. Cera Products, Inc., 2009 WL 871661 (T.T.A.B. 2009)
Peter Sloane successfully represented Novartis AG in an opposition mark CERAFLU for "oral hydration powdered nutritional supplement drink mix" in Class 5. The Trademark Trial and Appeal Board agreed that there was a likelihood of confusion with Novartis' mark THERAFLU for cold and cough preparations. In upholding the opposition, the Board found THERAFLU to be a "distinctive, strong and famous mark."
