PROFESSIONAL PROFILE:
Yuval
H. Marcus specializes in litigating all types of intellectual property
disputes, including copyright, trademark, trade dress, patent and trade
secret matters. His experience includes obtaining injunctive relief
against infringers; defeating motions for injunctive relief; prosecuting
and defending copyright, trademark, trade dress and patent infringement
claims; conducting domain name dispute proceedings; and commencing and
defending oppositions and cancellations before the U.S. Patent and Trademark
Office.
With the perspective of a seasoned litigator, he also counsels clients
on how to utilize effective IP strategies to strengthen IP rights in
advance of litigation and/or to minimize the risk of litigation. He
works closely with his clients to understand their short and long term
business objectives and tailors a program designed to take advantage
of the various IP tools available.
He is a Co-Chair of the Intellectual Property, Computer and Telecommunications
Law Committee of the Westchester County Bar Association and a Co-chair
of the Intellectual Property Committee of the Westchester/Southern Connecticut
Chapter of the Association of Corporate Counsel (WESFACCA). He has lectured
and published articles on many intellectual property topics, including
trademark infringement liability for purchasing trademarked keywords
in search engine advertising; avoiding the cancellation of trademark
registrations based on fraudulent procurement; the copyright fair use
doctrine; the NTP v. RIM BlackBerry patent case; and trade dress law.
Mr. Marcus hosted an INTA roundtable in January 2010 on the topic
“Policing Trademarks on the Internet and Web 2.0” and presented at
the Search Engine Strategies 2009 Conference and Expo in August 2009
in San Jose and in March 2009 in New York on several different IP
topics. His article entitled “In re Bose Corporation – The Federal
Circuit Overturns the Standard for Fraud in Trademark Cancellation
and Opposition Proceedings” was published in the November 2009 issue
of the Westchester County Bar Association Newsletter. " Other
articles that he authored or co-authored include the following three
articles published in May 2009: "TTAB Fraud" published in The
Intellectual Property Strategist; "The Importance of Corporate
Copyright Compliance" published in VIP Magazine; and "Rescuecom v.
Google -- The Second Circuit Holds that Google's Sale of Trademarked
Keywords May Give Rise to Liability for Trademark Infringement"
published in the Westchester County Bar Association Newsletter.
He has represented clients from many different fields, including the
technology, software, railroad, publishing, entertainment, restaurant,
hotel, apparel, toy, jewelry, luxury goods, furniture, cosmetics and
consumer goods industries.
